Workers’ Compensation for Bastrop County Employees

All employees of Bastrop County shall be covered by the County's workers’ compensation coverage. Workers' Compensation is a form of insurance providing wage replacement and medical benefits to employees injured in the course of employment.

What is Workers' Compensation?

An employee who suffers a job-related injury or job-related illness shall be eligible to have all reasonable, necessary and related medical expenses paid for such injury or illness. If unable to work due to a job-related injury for more than seven (7) calendar days, non-law enforcement employees will be eligible for Temporary Income Benefits, which begin on the 8th day of disability. Salary Continuation will be provided for law enforcement employees.

What to do when you are injured or have an accident at work?

An employee who suffers an on-the-job injury or job-related illness shall notify their Department Head/Elected Official IMMEDIATELY, and will fill out the appropriate reporting forms. The Department Head/Elected Official will notify the HR Department IMMEDIATELY. Failure to report job related injuries or illnesses in a timely manner may affect an employee's eligibility to receive workers’ compensation benefits or delay benefit payments and is grounds for disciplinary action.

Is it an Emergency?

In the event of an emergency, please go to the emergency room immediately and contact HR at your earliest availability.

In the event of a non-emergency please contact HR immediately for instructions and forms needed to be evaluated by a workers' comp. treating doctor at St David's Care Now located at 717 State Highway 71 West Bastrop, TX 78602. Once HR is notified and an Incident/Accident Report has been received, you will be assigned a claim number and a workers' comp. adjuster will reach out within 72 hours to obtain any additional information needed for your claim.

TEMPORARY INCOME BENEFITS
(Regular Non-Law Enforcement)

Full-time regular non-law enforcement employees who must miss work because of job related injuries or illness shall be eligible to receive Temporary Income Benefits. Temporary Income Benefits are paid at seventy (70%) of the employee’s regular rate. Employees may use vacation, sick or other leave to supplement their Temporary Income Benefits to equal their gross pay received at the time of injury. Temporary Income Benefits shall continue for the period of the job-related disability or until Maximum Medical Improvement has been certified. Temporary Income Benefits shall not be charged against vacation, sick leave or other leave.

SALARY CONTINUATION PAYMENTS
(Law Enforcement)

Full-time regular law enforcement employees who must miss work because of job related injuries or illness are eligible to receive Salary Continuation payments. Salary Continuation is paid at one hundred (100%) of the employee’s regular rate. Salary Continuation will be paid for the period of the job-related disability. Salary Continuation will not be charged against vacation, sick leave or other leave.

PHYSICIANS RELEASE

An employee who has been receiving Temporary Income Benefits or Salary Continuation is required to provide a DWC-73: Work Status Form noting a full or modified duty release to return to work and signed by the attending physician before being allowed to return to work.
